For the unversed, McKenna served as a surrogate for the baby of Omar Ahmed and Nausheen Gilkar, who told the surrogate to drop the pregnancy after the fetus was diagnosed with a rare heart condition.
McKenna gave birth to the baby boy against the wishes of his biological parents and is now fighting to be named his legal parent. A recent update of the case revealed that she faced a major legal setback from the Supreme Court, following which the infant's biological parents issued a statement taking a jab at her.
Supreme Court rejected McKenna West's plea to intervene in custody fight
Alaskan nurse and surrogate McKenna West wanted the Supreme Court of the United States (SOTUS) to intervene in her custody battle with the biological parents of the child she gave birth to. On September 22, 2026, Adam Wolf, the attorney representing the baby's biological parents, told TMZ that 28-year-old McKenna's plea was rejected and the court decided to stay out of the custody drama.
Justice Elena Kagan made the decision on Tuesday, which means that the legal custody of baby Rumi (named Gabrielle by McKenna West) remains with his biological parents, Omar Ahmed and Nausheen Gilkar, for now.

After McKenna faced the major legal setback, Omar and Nausheen broke their silence. They spoke out through their legal representative Adam Wolf. The attorney shared a statement with TMZ that seemed like a sharp jab at the surrogate. Adam said Rumi's biological parents were "grateful" for the US Supreme Court's verdict. They were glad that the newborn will now be able to continue receiving proper medical care while being with his biological parents.
Throwing shade at McKenna West, the attorney mentioned that she would no longer be able to snatch the baby away from its biological parents. The statement could be read as:
"We are grateful that Rumi can continue receiving the treatment he needs to survive, and that he will not be stripped away from his parents, who are ensuring their child receives top-notch medical care."
Adam Wolf added that McKenna West's legal bid was rejected by multiple courts across three states, and the baby's biological parents were glad it turned out in their favor. The statement accused the surrogate of trying to undermine Omar and Nausheen's rights to provide their child with the necessary medical attention. The statement's contents read:
"Ms. West's legal filings across three states, numerous courts of appeals, and now the US Supreme Court have sought to undermine Rumi's parents' right to provide him with the care he needs. Those efforts have been rejected by every single court."
About a month ago, the couple shared that their baby boy is in a critical condition. Days after McKenna West gave birth to Rumi, the newborn underwent a complex open-heart surgery called the Norwood Procedure. His biological parents, Nausheen Gilkar and Omar Ahmed, claimed that it was the first of three surgeries required to treat Rumi's hypoplastic left heart syndrome, a life-threatening condition.
There hasn't been any update on Rumi's condition since then. The only information shared by his biological parents is that they are focused on getting the newborn the best possible medical care.
