Amid the uncertainty about how long it will take for him to recover, Perez's mother has filed for temporary custody of the blogger's three children. And now it has been revealed that Perez was still being held under the Baker Act when he signed over the papers.

Perez Hilton's mother has filed for temporary custody of the gossip blogger's three children after he was hospitalized following a mental health crisis last week. The document obtained by Page Six showed that she will be able to consent to any medical care the children need, have access to their records, and make educational decisions, as well as "all other things necessary for the care of the children." The document read:
"I realize that by signing this document, I am consenting to the Petitioner having temporary legal custody of the minor children and that such temporary custody is in the best interest of the children. I realize that the custody of my children by the Petitioner is temporary and that I may, at any time, petition the court to return legal custody to me. I understand and acknowledge that I may have to comply with a reasonable transition plan prior to the court returning legal custody to me."

Perez Hilton's mother, Teresita Lavandeira, has filed for the temporary custody of the blogger's three children. For the unversed, Perez is a father to Mario Armando Lavandeira III, Mia Alma, and Mayte Amor. He welcomed all three of his children via surrogacy. According to reports, Mario Armando Lavandeira III was born in February 2013 via a gestational surrogate. Perez then welcomed his second child, Mia Alma Lavandeira, in June 2015, followed by his youngest, Mayte Amor Lavandeira, born in October 2017.
While Perez Hilton recovers in the hospital, Teresita Lavandeira will be taking over as the legal guardian of the three children. However, TMZ reported that Perez was under the Baker Act until Saturday, August 8, 2026, and that he signed the papers on Friday, August 7, 2026. This has led many to question what the act is and how Perez was allowed to make a decision while being held under it.
According to the Florida Department of Children and Families, the Baker Act focuses on crisis services for individuals with mental illnesses during medical emergencies. The act allows medical professionals to take and hold an individual for involuntary examination for up to 72 hours "if there is reason to believe he/she has a mental illness and due to the mental illness, the individual has refused or is unable to determine if examination is necessary."
The act is also applicable if it is established that, without treatment, the individual won't be able to take care of themselves and it will result in substantial harm to their well-being. Additionally, the Baker Act is also applicable "if it is likely, based on recent behavior, that without treatment, the individual will pose a serious threat to themselves or others."
According to reports, Perez Hilton signed the papers while being held under the Baker Act, also known as the psych hold. He was allowed to do so, as the hold doesn't necessarily mean that the individual is not in the state to understand others, but rather means he is not able to take care of himself or others around him.
