Amid the latest revelations, celebrity criminal defense attorney Seth J. Zuckerman has reflected on what this could mean for the case.
Nick Reiner charged with "lying in wait" charge
According to the latest reports, Nick Reiner is being charged with "lying in wait" for the murder of his parents, Rob and Michele Reiner. The new court documents have alleged that he may have launched the "surprise attack" after eerily "watching and waiting" to make his move. Amid the new allegations, criminal defense attorney Seth J. Zuckerman has explained what this might mean for Nick in a conversation with Page Six.
During the interaction, criminal defense attorney Seth J. Zuckerman revealed that Rob and Michele Reiner may have been "unaware that this was going to happen" and that Nick could have been "watching and waiting." He explained that the new charge differs from premeditated murder, which only required "proof of active planning and deliberation," or thinking out committing an act of murder. He added:
"'Lying in wait' is a legal-specific action where you concealed the purpose, you waited, and you launched a surprise attack."
The Zuckerman Legal Group founder further shared that the new charge means prosecutors may have proof that Nick Reiner was waiting for a period of time before making his move. The new charge also creates a new hurdle for the defense's insanity argument. For the unversed, Nick has battled drug addiction and mental health issues for years. Seth J. Zuckerman said:
"There must be some evidence here, whether it's surveillance footage, text messages, witness testimony, a diary entry, or something that shows that he was lying in wait and planning to do this. I'm assuming they were anticipating a psychiatric defense. And the 'lying in wait' certainly impacts that because it proves that he didn't snap, right? That he intended to do this, that he ambushed them, that he was waiting for them to come home and he did a surprise attack."
The new charge against Nick Reiner may lead to a harsher sentence if proven
According to criminal defense attorney Seth J. Zuckerman, if the charge against Nick Reiner is proven, he might face a harsher sentence. It was on August 12, 2026 (ET), when a newly unsealed grand jury indictment revealed that Nick was charged with the murder of his parents, with a special circumstance allegation that the defendant "committed the murders by means of 'lying in wait.'"
For the unversed, criminal defense attorney Seth J. Zuckerman pointed out there is a moratorium on the death penalty in California under Gov. Gavin Newsom. While Los Angeles County District Attorney Nathan J. Hochman called the indictment a step towards justice in a press release, Nick Reiner has maintained his "not guilty" plea so far.
However, with the new charges, it remains unclear whether his defense will go for the "insanity" route. Nick Reiner is scheduled to appear in court for a pretrial hearing on September 15, 2026. Criminal defense attorney Seth J. Zuckerman said:
"This is direct evidence of the defendant's state of mind. It makes it death-penalty eligible or eligible for life without parole."
