Add BollywoodShaadis on GoogleA young surrogate mother by the name of McKenna West has found herself grabbing all the headlines after she decided to have the child against the wishes of the biological parents. Most recently, the couple filed a temporary restraining order against McKenna. At present, the legal mess shows no sign of stopping, with McKenna now claiming she was under threat of facing a six-figure fine under her surrogacy contract.
McKenna West revealed the massive fine she could face for not aborting the baby
A California-based couple, Nausheen Gilkar and Omar Ahmed, asked the surrogate, McKenna West, to terminate the pregnancy. This was after doctors had revealed that if the child was born, he/she would have left heart syndrome, which is a life-threatening heart condition. But instead of doing as the biological parents asked, McKenna chose to flee to Texas and give birth to the child anyway.
In the latest update, McKenna revealed that she was facing a six-figure fine under her surrogacy contract if she didn't abort the baby. After McKenna gave birth to a baby boy she named Gabriel on August 12, 2026, the Texas Attorney General Ken Paxton not only spoke out in her favor but also took all the necessary steps to ensure that two Texas hospitals would provide medical care to the baby.
In a lawsuit that McKenna filed against Worldwide Surrogacy over the baby she was carrying, she detailed how much she struggled with the abortion demand made by Nausheen and Omar. According to her, she had “a baby boy with a heartbeat, capable of feeling pain, kicking inside.” She also claimed that she had “bonded with baby Gabriel for over four months after he grew and developed - sharing nutrition, oxygen, antibodies, and hormones with him.”

Since she refused to comply with the abortion demand, McKenna revealed that she was threatened with “severe financial repercussions.” She said that Naureen and Omar tried to invoke an abortion-upon-demand clause in the surrogacy agreement. This would force her to get the procedure or face the massive financial consequences.
McKenna admitted that she initially planned on getting the abortion and had scheduled it in May 2026. But ultimately, she could not go through with it. Following this, McKenna gave the proposal to Nausheen and Omar to raise the kid on her own, but they soon shot down the offer.
In the lawsuit that McKenna filed, she opened up about how a lawyer hired by the couple in the surrogacy negotiations had threatened her with the financial consequences. They reportedly told her that if the termination did not occur, she would have to cough up a whopping USD 250 million.
Meanwhile, in the documents filed by Nausheen and Omar, the couple accused McKenna of having received significant financial benefits under the contract. These included payments for her medical fees, travel, and living expenses that went up to USD 60k.
McKenna West has been stripped of any authority over the baby she gave birth to
As per legal documents obtained by TMZ, the California couple recently filed a Temporary Restraining Order (TRO) against McKenna. This effectively stripped the surrogate mom of all decision-making authority with regard to the child’s care, even though she gave birth to him. McKenna cannot make any medical decisions regarding baby Gabriel's health or exercise any parental or guardianship rights.

She also cannot legally represent herself as his parent, guardian, or medical decision-maker, or sign any document on his behalf. Furthermore, McKenna will not be allowed to remove the baby from the hospital and has no right to interfere with the biological parents' "exclusive right of access" to baby Gabriel.
