Surrogate McKenna West, a nurse from Alaska, has been grabbing attention. McKenna agreed to carry and deliver a baby for an LA-based couple, Nausheen Gilkar and Omar Ahmed. During the surrogacy agreement, McKenna was presented with a clause that allowed the biological parents to choose to terminate the pregnancy if any 'anomaly' was found.

While still a fetus, the baby was diagnosed with hypoplastic left heart syndrome, which is a rare birth condition in which the left side of the heart doesn't fully grow. After the diagnosis, the biological parents asked McKenna to have an abortion, which she refused; she moved to Texas and gave birth to a baby boy there. She named him Gabriel, who was soon taken to the NICU for further treatment.

However, it's the biological parents who filed a temporary restraining order against McKenna before the child was even born. As per the documents obtained by TMZ, McKenna is not allowed to make any kind of decision regarding the baby, and the authority has gone straight to his biological parents. On the other hand, McKenna is also not staying quiet and vowed to fight legally with the biological parents of her baby.

Her lawyer recently spoke to The Post and mentioned that McKenna is the mother, and if anyone gives birth in Texas, where abortion is banned by law, the baby is only the birth mom's child. McKenna is seeking the parentage of her baby boy, Gabriel, whose name has since been changed by his biological parents, as reported by The Post. Stating that McKenna is the mother under Texas law, her lawyer argued:

“She is the mother. She is seeking parentage of the child because she gave birth in Texas, and in Texas, if you give birth to a child, it’s your child. We think that once that California judgment is removed … that basically she is the mother under Texas law."

McKenna West's lawyer said the nurse is ready to fight legally and is even willing to take this to the Supreme Court if she has to. According to the lawyer, these abortion clauses, which require a pregnant woman to opt for abortion during the end phase of the pregnancy, are common. However, it's linked to a 'hitman contract,' according to the lawyer, Wilson.

Speaking of the baby, his surrogate mother, West, as of now is stripped of the ability to make any medical decisions that are required to be made. Wilson shared that the newborn will have to undergo a series of heart surgeries, with the first three taking place within a few weeks. The lawyer further added that the hospital where the baby will be treated has a very high success rate, which is a clear-cut sign that the baby and the mother are in good hands. To quote the lawyer:

"Within a few days, the first of three surgeries will be performed. It’s called the Norwood procedure. But thankfully, we are at a hospital that has a 100% success rate in giving that procedure, so we know that she and well, at this point, baby Gabriel are in good hands."

If the reports are to be followed, the legal battle between McKenne and the biological parents of Gabriel began soon after he was diagnosed with a rare heart defect. Reportedly, McKenna initially agreed to the clause but later moved to Texas and gave birth in a Dallas hospital. She was reportedly not allowed to hold or see the baby due to court orders.
