The investigation into the alleged murder of Pune realtor Ketan Agarwal has taken another twist after Siya Goyal's lawyer argued that any confession made by his client while in police custody cannot be treated as admissible evidence in court. The remarks come days after police claimed that Goyal and co-accused Chetan Chaudhary confessed to plotting Ketan's murder and recreated the crime scene at Lohagad Fort.

Ketan, 26, died on June 18, 2026, after allegedly being pushed into a gorge at Lohagad Fort. Police have accused his fiancée, Siya Goyal, 20, and her alleged boyfriend, Chetan Chaudhary, 22, of conspiring to kill him ahead of their planned November wedding.

Siya's lawyer questions the credibility of her alleged jail confession

Advocate Aashutosh Srivastava, who will be appearing as Siya Goyal's defence, told ANI that the alleged statements that his client made while in police custody, including the remarks that she confessed to pushing Ketan off the cliff, hold no weight as evidence under the Bharatiya Sakshya Adhiniyam (BSA). Srivastava argued that any confession made while an accused is in police custody or under pressure cannot be relied upon in a criminal trial. He was quoted as saying:

"I have said before that what was previously Section 25 of our Indian Evidence Act is now Section 23 in our new law, the BSA (Bharatiya Sakshya Adhiniyam). It states very clearly that if any accused makes any kind of confession while in detention or police custody, where they are under pressure or under threat, then such confessions cannot be considered admissible evidence at all in any criminal law. We will certainly raise this issue as well."

The defence also said that it would be the prosecution's responsibility to produce 'corroborative evidence' independently if it intends to prove any allegations against the client (Siya). Given that there has been no charge sheet yet, no alleged statement bears credibility. He told the media:

"If the prosecution has any corroboratory evidence, they can produce it as the case progresses. As I mentioned earlier, the investigation is currently ongoing, and a charge sheet has not yet been filed, so we will have to see... Our arguments will focus on the allegations made in the registered FIR and the investigation conducted so far."

Defence questions why the case shifted from accidental death to murder

Srivastava further questioned why investigators initially treated Ketan Agarwal's death as an 'accidental fall' and later registered it as a murder investigation. While the prime accused, Siya, and her lover, Chetan Chaudhary, have allegedly confessed to plotting Ketan's death, the defence believes it could be the result of high-pressure custodial interrogation. The defence stated:

"We will argue that the prosecution has already been granted sufficient time, specifically, ample police custodial remand to conduct any inquiries, interrogations, or information gathering required from Siya... We will...present the facts surrounding the FIR: specifically, what prompted the prosecution or investigating agency to shift the perspective from an accidental death to a potential murder case. From the defence's standpoint, there is no concrete reason to pursue this as a murder trial."

Police take Siya Goyal to recreate the crime scene at Lohagad Fort

Earlier on Sunday, June 28, 2026, Pune Rural Police took Siya Goyal and Chetan Chaudhary to Lohagad Fort to recreate the alleged murder using a dummy matching Ketan Agarwal's weight. According to Deputy Superintendent of Police Gajanan Tonpe, investigators reconstructed the sequence of events based on Siya's version of what allegedly happened on June 18, 2026.

As per a recent report, police revealed that Chetan and Siya went to the crime scene 'alone' before she took Ketan there, and her beau followed them. According to the police, Chetan and Siya 'rehearsed' murdering Ketan and executed the same on June 18, 2026. According to the same reports, Chetan and Siya were fully prepared and even practised answers in case they were caught. The duo even reportedly planned to disguise themselves during the murder so that no one could suspect them.
