Within three months of that, just a few days before her 37th birthday, Hayden's passing left everyone shocked, leading many to wonder about what might have caused her sudden demise.
Initially, it was reported that Hayden was last seen with her ex-boyfriend, Brian Hickerson, before her passing. On the other hand, details started emerging that Brian Hickerson and his brother were with Hayden during her final moments. Along with that, another report hit the headlines that revealed how Brian, only three days before the actress' death, was called out in court for his alleged drug abuse.
Hayden Panettiere's ex, Brian's brother, Zach shares what happened on the day of the actress's passing
It was reported that Hayden Panettiere was found in cardiac arrest at an apartment in Greenville, South Carolina. While an official cause of death has not been revealed just yet, emergency dispatch audio referred to a potential overdose. While the initial autopsy showed that there were no signs of physical trauma or suspicious circumstances surrounding her death, Law Enforcement also revealed that there was no indication of foul play in Hayden Panettiere's passing.
Amid this, in an interview with TMZ, Brian's brother, Zach, shared some new details. Zach addressed the speculations and revealed that the truth will come out once the investigation is completed. Stating that people who love Hayden deserve the truth, Zach revealed what happened on August 16, 2026. According to him, he was invited by Brian to lunch and an indoor game.

However, when he arrived at the Airbnb that day, both Brian and Hayden were napping. After this, when Zach and Brian tried to wake Hayden, they realised she was unresponsive, prompting them to call 911 immediately.
Brian gave Hayden Narcan, and both of them performed CPR. As Fire and EMS arrived, they tried to save the actress but were unable to. Zach called Hayden, one of his close friends, and shared that it was just heartbreaking. An excerpt of Brian's brother Zach's statement could be read as:
"I knocked loudly which apparently woke Brian up from a nap they were both taking on the pull-out couch bed in the living room. When we went in and tried to wake Hayden up for lunch, we realized she was unconscious. I immediately called 911, and Brian gave her Narcan. We then jointly performed CPR while 911 was on speaker until Fire and EMS arrived. At that point we watched as they tried every measure possible to save her life.”

Just three days before Hayden Panettiere's passing, Brian Hickerson was called out in court during a hearing. For the unversed, Brian filed a legal motion to expunge his 2020 domestic violence conviction, which involved Hayden Panettiere. However, his request was denied due to 'continued demonstrable drug use' as well as last year's arrest.
If the reports are to be believed, while Hickerson and his lawyer were not present, the D.A. had several points to reveal in court. Apparently, Brian was arrested last year as well for being high at a West Hollywood restaurant.
Apart from that, during an interview with TMZ, where Brian detailed his relationship with his 'victim' after the release of her bestselling memoir, he was 'high' on drugs. This led the judge to deny Brian's attempt to clear his record. Launching the TMZ interview, the D.A said in court:
"There is a documented interview where he speaks for 15 minutes about the abuse that's been documented in his victim's best-selling book, and he makes several admissions about that. And more significantly to his request today, he is quite high on what appears to be a stimulant, notwithstanding his lawyer's representations that he is seeking expungement because he is now sober. He is very -- very clearly not sober."
