Halle Berry is currently making headlines for all the wrong reasons. Her personal life has come under intense scrutiny following child abuse allegations made by her ex-husband, Olivier Martinez. He accused her of physically abusing their 12-year-old son, Maceo, and requested sole custody and a temporary restraining order against her.

Amid that, Oliver's past violent altercation with Halle's first child's dad, Gabriel Aubry has resurfaced. It raised questions about which of Maceo's parents can provide the pre-teen with a safer environment to grow up in.

Gabriel Aubry accused Halle Berry's ex-husband, Olivier Martinez of threatening to kill him

Halle Berry's love life has been anything but peaceful. From facing abuse to seeing her ex and present partner engage in a nasty physical fight, she has been at the center of several controversies. Halle began dating French actor Olivier Martinez in 2010, shortly after her high-profile split from Canadian model Gabriel Aubry.

Halle and Gabriel were embroiled in a bitter custody dispute over their daughter, Nahla Ariela Aubry, which hindered her future plans at that time. She and her then-fiancé, Olivier wanted to move to France with Nahla. However, their plans were foiled by a 2012 court ruling that blocked the relocation, allowing proper co-parenting with Gabriel.

It reportedly made Olivier furious, and he hit Gabriel, leaving the latter bruised and battered. On Thanksgiving 2012, Olivier allegedly threatened to kill Gabriel if he didn't let Halle and her then-four-year-old daughter, Nahla move to France with him. The two men got in a violent brawl outside Halle Berry's house, after which Gabriel Aubry was arrested on suspicion of misdemeanor battery.

Gabriel was also ordered to stay away from his daughter for five court days. However, in his filing, he claimed Olivier launched an attack on an unsuspecting Gabriel. The latter stated that the former punched him repeatedly, kicked him in the ribs, and banged his head against a concrete driveway. In Gabriel's words:

"He continued to punch me at least two or three times, kicked me in the ribs with his knee or foot, and took my head in his hands and slammed it to the concrete driveway."

After that, Olivier allegedly told Gabriel in an aggressive and threatening voice, "You cost us 3 million dollars [for the custody lawsuit]. When you see the judge you're going to go to Paris or I'm going to kill you." The altercation left Gabriel with a black eye, broken ribs, and some other wounds, while Olivier had an injured hand. Additionally, the court filing claimed that Olivier went to Nahla's school a day before the Thanksgiving incident, where he told Gabriel in French:

"I wish I could beat the s--t out of you right now...We're going to take Nahla right now and you're not going to follow us."

According to court documents filed in early October 2026, Oliver claimed that Halle choked their son, Maceo, asking him if he thought he was more dominant than Halle, during a heated argument that took place on September 26, 2026. It started with Halle criticizing Maceo's VR gaming, and him not agreeing to stop playing to listen to his mom.

The next month, Olivier filed a case against his ex-wife, and the court partially granted his request, ordering Halle to stay at least 100 yards away from him. She will, however, be allowed unsupervised meetups with their preteen son. She can see Maceo only during court-ordered visitation, which is two days a week and every other weekend, until an October 16, 2026 hearing.
