According to reports, Lindsay Clancy will remain in custody as her case proceeds. She is currently receiving treatment at Tewksbury State Hospital, where she is being held without bail. Her fate remains unclear as her first trial ended in a mistrial. As of now, the case against Lindsay is still active.
Speaking to PEOPLE, legal expert Neama Rahmani shared that the Plymouth County District Attorney’s Office will likely continue to prosecute the case. Neama added that a new trial could potentially happen in late 2026 or early 2027, depending on the court's schedule. Rahmani said:
"She will be prosecuted. There is too much political pressure. This is how district attorneys get voted out of office, if they cut her loose or they even cut a deal. Three children are dead. Depending on the judge’s schedule, in the next few months, late 2026 or early 2027, we start the proceedings all over."
Neama added that Lindsay will remain in custody after the mistrial ruling. Rahmani stated that the Massachusetts mom would continue to be held at Tewksbury State Hospital, a state hospital, where she is being held without bail. Lindsay’s trial has now become a national story and has sparked polarizing debates over the issue of postpartum psychosis.
Judge William Sullivan officially ended Lindsay’s trial without a verdict. Earlier, he had said he had "no choice" but to declare a mistrial because the jury could not reach an agreement. It was Lindsay’s defense attorney, Kevin Reddington, who asked William Sullivan to wait before making the decision, so the judge temporarily delayed it. But as the delay ended, the judge formally declared a mistrial.

The jury had already been struggling to reach a decision regarding Lindsay Clancy’s case. On September 4, 2026, they once again highlighted the matter to Judge Sullivan. They wrote, "With a heavy heart, we report we are unable to come to a unanimous decision. We will not be able to." Lindsay’s defense attorney asked the judge to delay declaring the mistrial only to ask the Massachusetts Supreme Judicial Court to intervene.
Judge Sullivan gave the defense one hour to make the emergency request. But as the request was rejected, Judge William Sullivan declared the mistrial. On September 3, the jury had sent the judge a note suggesting that one juror was not agreeing with the other jurors. Both prosecutors and defense agreed that the Massachusetts mother killed her three children by strangling them with exercise bands in January 2023. Afterwards, she jumped from a second-story window, leaving her paralyzed from the waist down.
The biggest question in Lindsay’s trial was whether she was legally responsible for the killings because of her mental state. While prosecutors said Lindsay knew what she was doing and intentionally killed her children, the defense argued that she was suffering from postpartum psychosis and had been overmedicated, which affected her ability to understand or control her actions.
