The tragedy took place just hours after a court ruling gave the 4-year-old's primary custody to her father.
Cibelle Savella, 35, was supposed to hand her daughter, Vivian Savella, over to her ex-husband, Aaron Savella, on Tuesday evening, September 29, 2026. Instead, Vivian was found dead from an apparent gunshot wound in her mother's house.
Vivian was supposed to go home with her father after the custody hearing
The tragedy unfolded after a lengthy and contentious custody battle between Cibelle and her ex-husband, Aaron. Court documents cited by local media allege that earlier that day, a judge had granted Aaron temporary exclusive rights to determine Vivian's primary residence and make decisions involving her education and medical care. On the other hand, Cibelle's time with her daughter was only restricted to continuously supervised visits.
But that's not the whole story. The ruling also placed additional restrictions on Cibelle after she said she could not speak Portuguese to Vivian unless a supervisor who understood the language was present. The 35-year-old was also restricted from attending the child's school activities and extracurricular events. The court ordered her to contribute to Vivian's child support expenses and over 50% of out-of-pocket medical expenses.

The custody order had only just been issued, and according to Aaron's attorney, the court order had not yet established exactly how Vivian's exchange between the parents was supposed to happen. The attorney also said the agency responsible for supervising Cibelle's visits had not yet been formally notified because the ruling had been made that day.
According to a statement released by Vivian's family through their attorneys, Aaron believed his daughter would be coming home with him that evening. The family shared:
"Vivian was 4 years old. She was loved without limit by her father, Aaron, and by everyone whose life she touched. There are no words for what has been taken from us."
The statement noted that Aaron had "trusted the courts" and followed the orders, waiting for the custody proceedings to move forward. However, the little girl never reached her father's home. The devastating statement reads:
"Aaron did everything the law asks of a parent who is trying to protect his child. He trusted the courts. He followed every order. He waited for the process to work. On Tuesday, a judge placed Vivian in his primary care, and she was supposed to come home to him that evening. She never did."
The tragedy has also left the attorneys involved in the custody case stunned. Charlotte Rainwater, who represented Aaron, told KHOU that she had practiced family law for 28 years and had never experienced anything like the outcome of the case. Rainwater said, "I don't think anyone in this courtroom on Tuesday contemplated this could be the outcome."
What happened after Vivian reached home with her mother?
Houston police officers responded to the 300 block of Terra Reserve around 5:45 p.m. following reports of a shooting on the home's third floor. Inside, they found Vivian suffering from an apparent gunshot wound. She was pronounced dead at the scene. There is no confirmation of whether she had psychological issues.
The officials noted that both Vivian and her mother were inside the home at the time of the shooting. The mother, Cibelle, was also reportedly found severely injured from what is believed to be a self-inflicted gunshot wound to the face. She was taken to a hospital for treatment, but HPD later reported that she also died the next day.

The child's stepfather and a babysitter were also reportedly present inside the house when the shooting occurred. They reportedly heard the gunshots and forced their way into Vivian's bedroom, where they attempted to help her before emergency responders arrived.
Investigators are currently examining the circumstances surrounding the apparent murder-suicide.
