Surrogate McKenna West 'Trying To Steal The Child', Biological Mother Breaks Down In Court

It is worth adding that it was during the 20-week scan, the couple found out that the child in the womb would be born with hypoplastic left heart syndrome which is a rare congenital condition in which heart do not develop correctly.

After the heart-wrenching diagnosis, the couple Nausheen Gilkar and Omar Ahmed asked the surrogate to abort their child as per the contract they had. But instead of aborting the baby, MeKenna flew to Texas where abortion is illegal. After the birth of the child, the couple is fighting a multi-state legal battle.
In the recent court hearing, the biological mother, Nausheen bared her heart out and claimed that the surrogate mother was trying to steal their child. She was testifying in a hearing on whether a temporary restraining order that prevents McKenna from seeing the baby should be enforced. The biological mother stated that McKenna West has been making them run from doctor to doctor, and has been trying to steal the child from them. She said:
“She’s making us run from doctor to doctor, state to state. With our baby — she’s trying to take him."

The biological mother stated that she and her husband had already made the medical arrangement in California where they live, and the the surrogate with held the baby's medical records in Alaska. She stated that she had not even knew if their child was still alive for two months.
The parents are suing the surrogate for more than USD 100,000 for keeping the baby and not aborting as per their request. The couple had agreed to pay McKenna USD 60,000 to carry the child and they had stated the abortion clause which allowed them to terminate the pregnancy if there were issues with the fetus.
However, after the birth of the child, Texas' medical team has been trying their best to keep the baby alive and he is in intensive care unit of Dallas Hospital. It is worth adding that the surrogate decided on her own that she didn't want to terminate the pregnancy and flew to Texas.
The surrogate mother stated that she agreed to give up any claim to the baby if the couple agreed to commit to the surgery and continue his treatment. She just wanted to be sure that the baby stays in the Lone Star State for treatment where she argues that she is the presumed mother of the child under the law, and can decided for his medical care. McKenna wrote:
"I’m not fighting to try to take someone else’s baby. I’m fighting because this baby boy needs someone willing to advocate for and fight alongside him as he gets the ongoing treatment his fragile heart requires. I have asked for only one thing from the very beginning: A commitment that this baby will be provided the life-saving treatment he needs. That is all it would take to end this."

However, the baby's condition has gotten worse just a day before the hearing, which has left him in critical condition. And they appealed the court to postpone their court appearance. The filing stated:
"Serious medical developments have arisen that impact the health and safety of the child. The child is in critical condition and being closely monitored at the hospital."
