McKenna West is once again hogging the limelight, and this time because of her biological child's father. According to reports, he has filed a lawsuit against her, and here's what we know about it.

McKenna West rose to prominence after she gave birth to a baby as a surrogate despite the biological parents' decision to terminate the pregnancy. While the parents had filed a lawsuit against West, it has now been revealed that she is being dragged to court for yet another suit. According to reports, West's biological child's father has filed a petition against her.

McKenna West's baby daddy files a lawsuit against her

McKenna West is being dragged to court by her biological son's baby daddy as she continues to fight the biological parents of the baby she gave birth to against their will. According to the court documents obtained by TMZ, West's baby daddy, Robert Gross, is suing her in a new petition filed on September 2, 2026 (ET), in Alaska. 

McKenna West first made headlines as the surrogate who refused to terminate the pregnancy and had the child despite the biological parents' refusal. And now Robert Gross has made some shocking claims against her. According to Gross, he and West are not married and have never been married. However, they do share a son named Cassius West who was born in 2021. 

According to the court documents, Robert Gross has alleged that he should be granted sole decision-making authority for his and McKenna West's son, Cassius West. In his petition, Gross alleges that West fled to "Texas to avoid legal troubles here" and claims that her recent actions show she is not mentally stable enough to make decisions regarding Cassius. He has also made claims that West took their son to Texas and hasn't returned. 

Robert Gross wants the court to only allow supervised visits to McKenna West

In the court filing, Robert Gross has questioned McKenna West's decision-making ability, citing what happened in the surrogacy case. Given the recent events, he has now asked the court that West be allowed only supervised visits with their son, Cassius.  As TMZ first reported, McKenna is locked in a bitter court battle with Nausheen Gilkar and Omar Ahmed, the biological parents of the baby she recently gave birth to in Texas.

Presumably because of the more favorable laws for her position, McKenna West should have custody of the baby. Nausheen Gilkar and Omar Ahmed wanted to terminate the pregnancy due to a heart defect doctors found, but West refused. She had the baby, and now there's a court battle over who gets the kid, being fought in courts in Alaska, California, and Texas.

The new update came days after McKenna West gave birth to Gabriel. It was previously reported that the newborn underwent a complex open-heart surgery called the Norwood Procedure. His biological parents, Nausheen Gilkar and Omar Faruk, claimed that it was the first of three surgeries required to treat Gabriel's hypoplastic left heart syndrome, a life-threatening condition.

In a statement released by the couple's attorney, Lee Budner, it was revealed that his "clients immediately provided consent for the surgery to occur at the hospital's earliest availability." They further shared that the baby was taken into the operating room for surgery on August 17, 2026. He described the baby's condition and said that it "remains critical and complex, and his family seeks privacy in caring for their son on his long road to recovery." In court documents obtained by TMZ, Nausheen and Omar said: 

"Serious medical developments have arisen that impact the health and safety of the child. The child is in critical condition and being closely monitored at the hospital."
