Halle Berry's bitter custody battle with ex-husband Olivier Martinez has taken another dramatic turn after the actor was confronted with a past sworn statement denying a history of domestic violence between them.

During cross-examination in a Los Angeles courtroom, Martinez stood by his recent allegations against Berry. At the same time, his attorney argued that the earlier declaration addressed a financial matter rather than their custody dispute.

Halle Berry's lawyer grills Olivier Martinez on previous sworn statement

Marina Beck, Berry's lawyer, cross-examined the 60-year-old French actor on Thursday, October 22, 2026, for the fourth consecutive day. The former couple has been involved in an ongoing custody dispute and domestic violence restraining order hearing.

Beck pressed Martinez about his allegations that Berry, 60, had abused him during their relationship, including incidents he claimed dated back a decade. When asked whether he was alleging that Berry had committed acts of abuse against him over the previous ten years, Martinez replied, "Correct."

He also acknowledged making allegations about incidents happening in 2023, including claims involving Berry's alleged statements to their 13-year-old son, Maceo. The questioning then turned to a declaration Martinez signed under penalty of perjury on September 30, 2024. Beck presented the document and asked him to confirm his signature before directing him to a passage addressing the couple's history of domestic violence.

"There is no history of domestic violence between the parties," Beck read from the sworn declaration. She asked, "That statement was true when you made it on September 30th, 2024, correct?" To this, Martinez replied, "Correct."

The exchange highlighted an apparent inconsistency between Martinez's earlier sworn statement and his more recent allegations. However, his attorney, Patrick Baghdaserians, told Page Six that he submitted the declaration in connection with a request for need-based attorney fees, not a custody proceeding. He maintained that the declaration concerned financial issues rather than the parents' custody arrangements.

Halle Berry denies abuse allegations as her daughter, Nahla, openly defends her

The latest courtroom exchange comes amid serious allegations Martinez has made against Berry concerning their son. The actor previously accused the Monster's Ball star of choking Maceo during an alleged altercation at her home on September 26, 2026. He has claimed the incident was part of a broader pattern of behavior that caused the teenager significant emotional distress.

According to Martinez's court filings, Maceo contacted him after the alleged incident and asked him to come and collect him. The filing included messages in which the teenager allegedly wrote, "Please come," while asking his father to pick him up privately. A judge granted Martinez a temporary domestic violence restraining order earlier this month, giving him primary custody of Maceo and restricting Berry's contact with their son while the case proceeds.

Berry's attorney previously described Martinez's claims as "entirely meritless and deliberately misleading" in comments to Page Six. Now, the actress is seeking to have the restraining order request dismissed and the temporary restrictions lifted. She is also seeking sole legal custody of Maceo.

The dispute has also drawn Berry's older daughter, Nahla Aubry, into the proceedings. In a court declaration, the 18-year-old defended her mother, saying she had never witnessed Berry physically abusing her younger brother.

Nahla stated, "I have also never seen my mom throw anything at anyone, not a knife, or plate, or any other object." She also said she had never seen Berry hit, slap, choke, or grab Maceo in an abusive manner. Maceo had also spent nearly four hours testifying behind closed doors earlier in the week. The contents of his testimony have not been made public.

Halle Berry and Olivier Martinez married in 2013 and welcomed Maceo in the same year. The marriage eventually ended in October 2015, and the couple went their separate ways. The divorce lawsuit stretched on for years and was settled in August 2023.

The divorce agreement said the ex-couple would share joint custody of their son. Halle was ordered to pay Olivier USD 8,000 a month in child support. They also started court-ordered co-parenting therapy in 2024. Still, disagreement persisted over Maceo's parenting decisions.
