Can Lindsay Clancy Face A New Trial? Former Federal Prosecutor Says, 'Judge Will Have No Choice..'

In the initial days, the trial seemed like a direct case of murder, but it soon evolved into a debate over mental illness, in addition to criminal responsibility and justice. At present, the jury is in a deadlock, with Judge William Sullivan telling them to go back and continue deliberating. This has led many to wonder if Lindsay Clancy can face a new trial or not.
What are the chances of Lindsay Clancy facing a new trial?
It was on September 1, 2026, that jurors told Judge William Sullivan that they had been unable to reach a unanimous verdict in the Lindsay Clancy trial. If this continues, Sullivan might be forced to take an additional step to break the deadlock before the trial ends.
For those wondering if the jurors have been given what is known as a Tuey-Rodriguez instruction, a court clerk told PEOPLE that it is yet to happen. The instruction is usually meant to urge jurors to reconsider their views and consult each other without letting go of their individual beliefs. Legal analyst and former federal prosecutor Neama Rahmani told the publication that it comes from an old Massachusetts decision. They added:
“But it reminds the jurors that they’re supposed to consult with one another, reexamine their views, try to reach an agreement without giving up their individual judgment. The defense usually doesn’t like it because again, a hung jury favors them, but oftentimes the prosecution will ask for it, and the judge will give it. Sometimes it can help break a deadlock.”
Even after the jurors are given a Tuey-Rodriguez instruction and they say that they can't reach a verdict, that's when Judge Sullivan will have to go ahead and declare a mistrial. In Rahmani’s words, “If they come back and say, ‘We’re hopelessly deadlocked, we’re unable to reach the verdict,’ the judge will have no choice but to discharge them.”
Once a mistrial is declared, the prosecution will be left with two options: to retry or dismiss the case. According to Rahmani, he believes that there is barely any chance of the case being dismissed. Not only are there three dead children involved, but with the case getting worldwide attention, there will be a lot of political pressure on the prosecution to retry as well. He said:
“Not refiling the case is how district attorneys get voted out of office. I’m not saying that charging decisions are always made for political reasons, but when you deal with elected officials, public sentiment matters.”
He added that not prosecuting will mean that Lindsay Clancy will get to walk free just like her supporters hope. This would also mean that she won't have to spend time in a psychiatric facility for insanity.
If Lindsay’s case goes up for a retrial, Rahmani said that there's a high chance it will turn into a favorable situation for the prosecution. This is because the defense will no longer have the element of surprise. In his words:
“The prosecution knows how the defense witnesses will testify. They can better prepare. In this particular case, I think the prosecution can learn from their mistakes.”
