Delta flight attendants showcased a recurring pattern of misidentifying family dynamics as criminal activity.
Delta Air Lines management has recently come under intense online scrutiny after an Arkansas woman, Madison Cupp, accused the airline of ruining her life. In June 2026, Madison filed a lawsuit against Delta for USD 2.35 million, alleging defamation and infliction of emotional distress. The basis of the major step was a 2019 incident when the father of then-13-year-old passenger, Madison was wrongly accused of trafficking his daughter. Notably, Delta made a similar misjudgement in the case of another passenger, Peter Espinosa.
The Peter Espinosa case dates back to 2021, when he was working as a corporate tech executive and was a Delta Million Miler frequent flyer. During one of his flights with his special needs daughter, he had an unpleasant experience. The incident occurred when he was travelling in first class with his then-20-year-old ward, Rachel, from Minneapolis to Dallas over Father's Day weekend. Rachel has Fragile X Syndrome, a genetic condition and a leading cause of autism. The condition caused her extreme anxiety, difficulty in making eye contact, and made her feel overwhelmed in unfamiliar situations.
During Rachel and Peter's flight, a Delta flight attendant became focused on her visible anxiety and pressured her with questions. When her father tried to intervene and explain that his daughter would not be able to answer the questions, the flight attendant grew suspicious. The attendant then asked Peter if they only spoke Spanish, and confirmed his last name. He thought it was just a curious inquisition by the Delta employee, but he was proved wrong when they landed in Houston. Recalling how the attendant's behaviour left Rachel sobbing, Peter stated:
"He [flight attendant] kept trying to ask her direct questions, only making my daughter Rachel much more anxious...As my daughter teared up, I finally insisted and said, "She cannot answer you." His reply to her was ", Do you only speak Spanish?"...I said yes...I asked why is he so intent with speaking with my daughter? and he replied he was simply doing random greetings of customers. He thanked me for being a Delta Million Mile flier and left."
Due to Rachel's anxious reaction to the Delta Airlines employee's questions, he misjudged the situation and reported Peter Espinosa as a human trafficker to law enforcement. When the plane landed in Houston, Texas, four police officers were waiting at the gate to interrogate Peter. They separated him from his daughter, leaving Rachel even more anxious. He was taken to a nearby area for interrogation. Law enforcement officers quickly realised the situation was a misunderstanding and released him without any charges. One officer allegedly said, "This set of flight attendants had not been properly trained."
After the unpleasant flight experience, Peter wrote an open letter to Delta's CEO, Ed Bastian, detailing the incident and published it on LinkedIn. In the post, he accused the airline of racial profiling due to his Hispanic heritage and neglecting the basic needs of disabled passengers. He also mentioned the incident's after-effect on Rachel, stating that the experience emotionally shook her. According to him, it took him and his wife days to get their daughter back to a normal life. Delta responded to Peter via email, stating that they were only trying to ensure their passengers' safety. However, the issue led to immense public backlash against them.
