For those unaware, he is facing charges of aggravated sodomy and sexual battery after he allegedly assaulted a girl inside a gym changing area. Now, to make matters worse, KJ is being accused of having sex with an underage relative.
On September 11, 2026, Kim Zolciak’s son, KJ Biermann, appeared in Georgia’s Fulton County Superior Court for his sexual assault case involving a female classmate. However, before Judge Melynee Leftridge could make a ruling in the bond hearing, Deputy District Attorney Caitlin McGillicuddy made a shocking revelation that nobody saw coming.
Caitlin revealed that investigators had previously found videos on the 15-year-old’s cellphone where he could be seen having sex with a family member. What made the matter worse is that the family member was reportedly under the age of 12.
Caitlin claimed that there were “multiple encounters” taped on video that were discovered on the device. In the videos, KJ allegedly used “predatory, derogatory” language towards the victim. The attorney noted:
“This would now mark the second time he has been charged with an offense of a sexual nature of a very serious kind which involves female victims.”
In this new case, which had not been previously reported publicly, Caitlin said that KJ has been charged with sexual battery of a victim under the age of 16. She added that he was under court supervision for the charge since October 2025. This was 10 months before he was arrested on the separate aggravated sodomy and aggravated sexual battery charge.
As of now, KJ Biermann remains jailed at Atlanta’s Metro Regional Youth Detention Center. Judge Leftridge said that she will decide by September 14, 2026, whether KJ will be released on bond or not. In his plea for bond, the 15-year-old's defense attorney, Jason Sheffield, claimed that the whole thing has been pretty “traumatizing” for his client. He noted that KJ is not a boisterous kid and is somewhat quiet.
Jason went on to ask that KJ Biermann be released on a USD 65,000 bond. He also insisted that his mother, Kim Zolciak, would take the responsibility to monitor him, as she is at home and is currently not employed.
However, the prosecution was clearly not happy with this. Caitlin McGillicuddy shared how the victim in the sexual battery and sodomy case had suffered “documented physical injury” after KJ assaulted her. This is why Caitlin said that if the bond was really granted, it should be set at USD 190,000.
During the hearing, a statement from KJ Biermann’s female classmate was read aloud. In it, she asked the judge to “consider [her] safety” before deciding if it was okay to release KJ on bond. She claimed that she has been “living in fear” as she believed once KJ is released, he would come after her. The victim further added:
“No matter who these threats came from directly, I cannot just ignore them or assume that nothing will happen. I am not only scared for myself anymore; I am scared for my family, too. Members of my family have received emails and phone calls because of this situation.”
KJ Biermann’s female classmate accused him of assaulting her on April 23, 2026. She told the investigators that the Real Housewives of Atlanta star's son had allegedly forced himself on her despite her saying no when they were in a co-ed sauna.
As per the court documents, the girl said that KJ allegedly tried to have sexual intercourse with her multiple times. She claimed that she only managed to get away from him when he “pulled up his pants and left.”
When she told her family the next day about the alleged assault, the girl was examined at Wellstar North Fulton Medical Center. However, no evidence of male DNA was found on her.
