However, they have now filed for a TRO against West, stripping her of the rights to make any decisions about the infant.
McKenna West, the surrogate who ran off to Texas to have her baby without the biological parents' consent, has found herself in a new legal mess. According to a legal document obtained by TMZ, the California couple who are the baby's biological parents have filed a Temporary Restraining Order (TRO) against the surrogate, stripping her of any authority over the baby to whom she gave birth.
The news outlet obtained a copy of the TRO placed by the biological parents of baby Gabriel, the name that McKenna West gave the baby. The document strips her of any decision-making authority regarding the child's care. According to the document, West cannot make any medical decisions regarding baby Gabriel's health or exercise any parental or guardianship rights.
McKenna West cannot legally represent herself as his parent, guardian, or medical decision-maker, or sign any document on his behalf. The document also states that West is not allowed to remove the baby from the hospital and has no right to interfere with the biological parents' "exclusive right of access" to baby Gabriel.
It was previously reported that McKenna West and the biological parents had a surrogacy agreement with a strict set of rules in place. Everything was going fine; that was until the biological parents decided to abort the fetus. The decision was a part of their arrangement that stated that the couple could choose to terminate the pregnancy if an "anomaly" was found.
While still a fetus, the baby Gabriel was diagnosed with hypoplastic left heart syndrome (HLHS), a rare birth defect where the left side of the heart does not grow correctly. While the parents decided they no longer wanted to continue the pregnancy, McKenna West decided against it and ran to Texas to give birth, leading to the legal drama.
Now, the parents have filed a TRO against West, which authorizes them to receive health information concerning Gabriel and to make medical decisions on his behalf. The order is in effect at least until August 25 at 1 PM. After that, McKenna West is ordered to appear before the district court in Dallas County, Texas. It is also worth noting that the TRO was filed before Gabriel was born as a preemptive measure by his biological parents.
Amid the legal clash, an attorney for McKena West has told The Post that the surrogate mother plans on fighting the biological parents to become the legal mother of the infant. The lawyer has regarded West as the "mother" of Gabriel, while claiming that "[West] gave birth in Texas, and in Texas, if you give birth to a child, it's your child."
