A Californian couple asked their surrogate to terminate the pregnancy, but instead of accepting it, the woman fled to Texas and gave birth to the child. Currently, a judge in Dallas ordered life-sustaining care for the newborn. The child has been receiving stabilizing and is scheduled to undergo surgery at a Texas hospital.
It is a one-of-a-kind case, and McKenna's lawyer and her case had drawn widening national support from right-to-life groups and Republican officials. The surrogate mother, who was carrying the child for the California couple, accused the biological parents of wanting to abort the pregnancy after the fetus was diagnosed with hypoplastic left heart syndrome, which is a life-threatening heart condition.
McKeena hails from Alaska and was carrying the baby and it was during the fetus' 20-week scan that doctors found out he had hypoplastic left heart syndrome. It is a rare birth defect in which the left side of the heart does not develop properly. The child required three surgeries to correct it when the child was born.
However, the surrogacy agreement had a clause that if couple chose to terminate the pregnancy due to an anomaly found, McKenna refused to comply and instead she flew to Texas. She has been seen as the birth mother in Texas. As per reports, McKenna was due to give birth on September 2, 2026, but delivered her baby boy. She has named the newborn child Gabriel.
Currently, the intended parents' current focus is on the recovery and safety of their child and ensuring that he receives the medical care that is required for his good life. Their lawyer said:
"Our clients' only focus at this time is ensuring that their baby receives the medical care that he vitally needs and that they, as his parents, are able to spend every precious moment they can with him."
The parents are suing McKeena and a court date has been scheduled for a later month. It is unclear how this unique multi-state legal battle will play out. However, McKenna is not allowed to see or care for Gabriel, but she is considering taking care of the child if the court rules she can.
Texas Attorney General Ken Paxton has obtained an emergency court order requiring two Dallas hospitals to provide life-saving care to the baby. Meanwhile, McKenna's lawyer reportedly claimed that the termination clause within the surrogacy contract she signed is offensive to the state.
As soon as the news surfaced, Redditor shared their view points. One user wrote, "Both Alaska and Texas courts have basically voided the contract. Alaska said the contract couldn't be used to require medical procedures of the surrogate. So they can't make her get an abortion and anything in the contract related to that wouldn't be enforceable. Then she went to Texas where legally she can't get abortion, which would also void any requirements because a contract can't require you to do something illegal."
