Singer, D4vd a.k.a David Anthony Burke, got arrested on April 16, 2026, as the suspect in the killing of a 14-year-old girl, Celeste Rivas Hernandez. It was on April 20, 2026, that he was charged with first-degree murder of the girl whose decomposed body was found in September 2025, in the front trunk of a Tesla registered to his Texas address. The singer may face the death penalty, and amid this, his last post on Instagram related to his project has also surfaced.
David Burke, aged 21, has been charged with murder for financial gain, along with the murder of a witness related to the murder investigation, as mentioned by Los Angeles District Attorney Nathan Hochman. David could face the death penalty in this case, and amid the same, his last post on Instagram has gone viral. Singer D4vd's last post on Instagram was reportedly in 2025, when he shared news of his album, Withered. The singer had thanked his fans for waiting for him, as the album meant a lot to him. He had confessed to putting all his efforts into the same. D4vd in the picture had posted a sad snap of himself sleeping between white flowers and had captioned the post as:
"Thank you all eternally for waiting on me. This album means SO much to me, you have no idea the blood, sweat, and tears that came with trying to create this project over the past 2 years. Constantly starting over and over and over until there was nothing left on this audio landscape of a canvas than thoughts, melodies, and emotions that were unequivocally me. Pre-order Withered now at the link in my bio. Rollout starts with one more dance."
Nathan J. Hochman, who is the Los Angeles County district attorney, revealed in a press conference, according to Daily Mail, that D4vd has been charged with first-degree murder, adding the special circumstances of lying in wait. The singer has been accused of committing the crime for monetary purposes and murdering Rivas Hernandez, who had reportedly seen the sexual acts done by D4vd on the victim. The district attorney on the death penalty statement said:
"Because of the special circumstances, the charge carries a maximum sentence of life without the possibility of parole, or the death penalty."
Currently, Mr Hochman and his office haven't decided on whether to pursue the death penalty in the case. The defence lawyers of the singer had issued a statement saying that the singer had not murdered Celeste and that he was innocent. According to the latest reports, Hochman and his office have not yet decided whether to pursue the death penalty in the case of singer D4vd. However, a report by the BBC confirmed that the District Attorney's office can seek the death penalty in the case. Lawyers Blair Berk, Marilyn Bednarski, and Regina Peter revealed:
"Let us be clear, the actual evidence in this case will show that David Burke did not murder Celeste Rivas Hernandez, and he was not the cause of her death. There has been no indictment returned by any grand jury in this case and no criminal complaint filed. David has only been detained under suspicion. We will vigorously defend David's innocence."
Reportedly, Celeste had gone missing since 2024, and her mom had filed a missing persons report when she was merely 13. The mom told reporters that Celeste had a boyfriend named David. D4vd had a tattoo right on one of his fingers, which had an eerie text, 'shh'. The same tattoo was observed on Rivas's index finger.
