With worldwide attention on the case, the question that continues to linger on everyone's minds is whether Lindsay Clancy should be held criminally responsible for the killing of her three children. Recent reports suggest that Lindsay's next trial may take an unfavorable turn and not end in the way that she wants.
Lindsay Clancy’s lawyer Kevin Reddington revealed that he intends to ask Judge William Sullivan to set aside the hung-jury outcome that resulted in Lindsay’s first trial being declared a mistrial. If it is granted, Lindsay would avoid a possible second trial and potential conviction.
However, according to Boston lawyer Peter Elikann, who recently spoke to the New York Post, it would be “rare to the extreme” for a motion of this sort to succeed. Peter claimed that this was Kevin Reddington’s way of not leaving any stone unturned. In his words:
“Kevin Reddington has to be commended for leaving virtually no stone unturned. It’s commendable that he’s bringing this motion forward. The granting of [such] a 25(b)(2) motion is rare in the extreme.”
According to reports, Reddington will be seen arguing for the motion at Lindsay Clancy’s next hearing, which is scheduled for September 29, 2026. Peter explained that the only way Reddington’s legal move has any chance of succeeding is if he can prove without doubt that the jury during the six-week-long trial had managed to screw up pretty badly. Then the judge would be left with no choice but to set aside the deadlock result. Peter added:
“It would be used if it was genuinely believed that the jury got it totally wrong and that their decision was not based on sufficient evidence whatsoever. However, most judges go through their entire career without even granting one of those once.”
Notably, the only such motion that Peter Elikann could remember winning in the Bay State dated back to decades ago in 1997. At that time, a judge reduced the conviction of Louise Woodward from second-degree murder to manslaughter when the British au pair was tried in the death of 8-month-old Matthew Eappen. Peter said:
“We don’t undo what juries did. We really respect juries. It would have to be something that the jury got totally, totally wrong, and I don’t think anybody is accusing the jury of that here.”
The jury in the Lindsay Clancy case was made up of 12 people, which included nine women and three men. After deliberating over the course of 7 days for over 38 hours, they sent three notes to Judge Sullivan in that time to inform him that they were deadlocked. The last note that was read out by Judge Sullivan stated, “It is with a heavy heart that we report we are unable to come to a unanimous decision and will not be able to.”
When the jurors were brought back into the courtroom after the last note, Kevin Reddington asked Judge Sullivan to hold off on declaring a mistrial. The judge gave him one hour to file an emergency appeal with Massachusetts’ highest court. However, the appeal ultimately did not succeed, and it ended in a mistrial, as most had assumed.
As of now, the names of the jurors will be released on September 18, 2026. Peter Elikann predicted that both the defense and the prosecutors will be looking to see if any of the panelists give out any interviews so that they can understand their thoughts about the case. This would also help them decide what kind of strategy they should follow going forward.
