KJ Biermann Pleads Not Guilty In Sexual Battery Case Months After Lawyer Said He's '100% Innocent'

Kim Zolciak's 15-year-old son, KJ Biermann, has been in the headlines for all the wrong reasons. For those unaware, he was arrested on charges of sodomy and sexual battery after he was accused of assaulting a girl in a gym changing area. The case had garnered significant attention, leading to the teen facing public backlash.

KJ Biermann stayed behind bars for nearly one month and was released on a USD 200,000 bond. Now, in a new update, KJ has reportedly pleaded not guilty in his sexual battery and sodomy case.

KJ Biermann pleads not guilty in sexual battery and sodomy case

According to Page Six, KJ Biermann has officially pleaded not guilty to all seven felony charges in his sexual battery and sodomy case. This includes aggravated sexual battery, aggravated sodomy, aggravated child molestation, three counts of aggravated sexual battery against a child under 16, and false imprisonment.

The teenager filed the documents in Fulton County Superior Court on Monday, October 5, 2026, via his attorney Jason Sheffield. Jason told the judge overseeing the case that KJ has entered a not-guilty plea to every charge in the Georgia grand jury indictment. He also said that his client has waived his formal arraignment, which is scheduled for October 13, 2026.

Jason Sheffield went on to request a hearing date to transfer KJ Biermann’s case to Fulton County Juvenile Court before the court sets the pre-trial and trial dates in superior court. As of now, it has been revealed that the judge has approved dealing the documents in three separate “envelopes,” although the filing did not say what the documents or envelopes in question contained.

It is worth mentioning that months before KJ Biermann entered his not guilty plea, his lawyer Jason Sheffield had vouched for his innocence. In a statement shared with USA Today on August 21, 2026, Jason questioned why, since both the accused and the alleged victim were minors, the details regarding the case became public. He defended KJ and said that he believed his client was “100 percent innocent.” He said:

"First and foremost, this is not the kind of information that should be for public dissemination. These are juveniles. Secondly, my client is 100% innocent and tried to present evidence to the arresting officer."

According to the lawyer, KJ Biermann had already taken a voluntary polygraph test to prove his innocence after “prior false allegations by the alleged victim.” In fact, he had even tried to present the specialist-signed report to the arresting officer. Jason Sheffield further cited the police report notes and said that the investigators found no male DNA on or inside the areas identified by the alleged victim during the sexual assault examination.

For the unversed, KJ Biermann’s female classmate accused him of assaulting her on April 23, 2026. She told the investigators that Kim Zolciak’s son had allegedly forced himself on her despite her saying no when they were in a co-ed sauna.

As per the court documents, the girl said that KJ allegedly tried to have sexual intercourse with her multiple times. She claimed that she only managed to get away from him when he “pulled up his pants and left.”

After the alleged assault, she did not tell anyone about it until she went to school the next day and ran into KJ’s girlfriend. This prompted her to flee the campus and contact her family from a Starbucks, where the girl shared that she was having a panic attack.
