However, now Halle has alleged that not only did she never lay a hand on their child, but she is also a victim of domestic violence.
Halle Berry is firing back at Olivier Martinez, calling the allegations he has made against her "bullshit". And now, according to TMZ, she is alleging she is a domestic violence victim and advocate, not a perpetrator. The actress has filed a voluminous response to Olivier's petition to change their custody agreement from joint legal and physical custody to temporary sole custody, with Halle getting only visitation rights.
Halle Berry has responded to Olivier Martinez's allegations and said that she would never hurt their child. Instead, she has claimed that she is a victim of domestic violence herself. She has never said who abused her, other than that it was an ex. For the unversed, Halle was married thrice; before Olivier, she was married to Eric Benet and David Justice. Olivier has also accused Halle of making racially charged comments about him to Maceo. According to Olivier, she called him:
"A white bitch who takes money from a black woman."
However, her other child, Nahla Aubry, submitted a declaration saying she never heard her mom make racially charged comments. She says Olivier Martinez's allegations are "completely inconsistent with the mom I know." After the filing on October 5, 2026, the judge amended Olivier's temporary restraining order and clarified that the actress retains final decision-making authority over Maceo's mental health and education.
Olivier Martinez alleged that a week ago, while their son, Maceo, was playing a VR game, Halle put him in a headlock, choking him. Nonetheless, the actress has denied the claims. Meanwhile, Halle Berry has offered a completely different account of what happened.
Halle Berry alleged that she went in the room only to tell Maceo to turn off the game, then went to the bathroom, sat on the toilet, and started recording him on her phone while he kept playing. However, he noticed her filming, walked toward the bathroom, and grabbed her phone. The actress alleged that after that, they began "playfully roughhousing," as they often do. Nonetheless, she never had her hands around his neck or in any way that would choke or restrain his breathing.
She has also claimed that she never yelled, "Who is dominant now?", as alleged by her ex, Olivier Martinez. Halle Berry's court filing also includes still photos of Maceo wearing the VR goggles. She also submitted a timestamped video to back up her version of events and refute Olivier's. She does admit to telling Maceo, "You don't have anything to prove," as he pushed her.
Her boyfriend, Van Hunt, came upstairs as the confrontation heated up. Halle Berry claims that she tried to take Maceo's headset when he shoved her again. She alleged that it was then that her boyfriend intervened and got between them. However, the 13-year-old threatened to leave and go back to Olivier. She says she texted Olivier, pleading with him to enforce appropriate boundaries with their child.
Maceo then went back to his dad, Olivier Martinez's home. Halle has asserted that there were no marks on his body when he left. The actress has alleged that it would be "detrimental" to give Olivier primary custody because he's not capable of "child-centered guidance." She alleged that he has given Maceo authority to make medical decisions for himself and that Maceo shouldn't be allowed to choose the household where he doesn't have to follow rules.
Halle Berry has alleged that Maceo has behavioral and neurodivergent issues that require professional help. However, her ex-husband, Olivier Martinez, has been resistant to obtaining such help.
