Celina Jaitly urges women to consider signing a prenup before tying the knot

In a recent interaction with India Today, Celina Jaitly has urged women to consider signing a prenuptial agreement before tying the knot. The actress stated that it was important to stay financially independent and a prenup would further be of help if they own personal assets. The actress added that while relationships may begin with love, financial matters can become a source of conflict if a marriage ends.

Celina Jaitly who is currently in the middle of a messy divorce from her estranged husband, Peter Haag revealed that women need prenup to safeguard their hard-earned wealth and property. She revealed that in her marriage her biggest heartache would be the fact that despite she didn't sign a prenup. She was quoted as saying:

"I would recommend girls, please do a prenup if you have assets of your own. Please do a prenup before marrying. Keep your assets separate always. Because, you know, it all boiled down to assets. All the love, all the care, all the promises of togetherness, the children, the deaths, the births, everything boiled down to an asset at the end of the day. And that is what my biggest heartache is."

Celina Jaitly's advice comes amid her ongoing divorce battle with her estranged husband, Peter Haag. In the same conversation, the actress recalled receiving a divorce notice in Austria just before her and Peter's 15th wedding anniversary, saying the document was read out to her by her twin sons. The No Entry actress recalled that she initinally thought that the notice was just a letter from the municipality or related to her residence status.

She even joked with her now-estranged husband, Peter Haag about whether the authorities had sent her some money. Celina revealed that the notice, which she described as having been served on the pretext of a wedding anniversary gift, contained allegations against her and said that the marriage had suffered an "irretrievable breakdown". For the unversed, Celina married Peter in 2010. The couple welcomed twin sons, Winston and Viraaj, in 2012, and another son, Arthur, in 2017.

What is a prenup and are they vaild in India?

For the unversed, a prenup or a prenuptial agreement is a legal contract signed before marriage that specifies the financial future of the couple in case a marriage ends. The document details how a couple's assets, debts and property will be handled if the marriage ends in a divorce for any reason. It can also help ensure that property owned by either partner before marriage remains separate, offering greater financial security. However, is prenups vaild in India?

Well, according to reports, Indian Matrimonial Statutes (like the Hindu Marriage Act, 1955 or the Special Marriage Act, 1954) do not expicitly recognise or enforce prenups as marriage is seen as a sacred commitment than a commerical contract. However, they can hold some value in court. While they are not binding contracts in India, they can act as an evidence of financial intent and understanding between couples before marriage.

Nonetheless, Goa is the only state in India where prenups are not only legal but fully binding. Talking about religious courts, while Hindu Marriage Act doesn't hold prenup, Muslim law considers Nikahnama as a functioning and valid prenup.
