In an August 7, 2026, interview, Boltinhouse claimed she lost the crown due to her conservative Christian beliefs, while organizers denied this and said the move was based on past conduct that did not meet pageant standards. The matter has now taken a new turn as Brittany Boltinhouse has filed a lawsuit against Miss USA.
Brittany Boltinhouse has initiated legal action against the Miss USA organization, accusing it of removing her Miss North Carolina USA title because of her conservative political views and then publicly portraying her as prejudiced.
According to the new legal documents, Boltinhouse has filed a lawsuit against the Miss USA Organization, its CEO Thom Brodeur, and the team behind the Miss North Carolina USA pageant for defamation and civil conspiracy. She is seeking compensatory and punitive damages, with the amount to be determined by a jury. The petition begins with lines from Beyoncé's song Heated, which says:
“Whole lotta, yeah, money, not a lot of patience. Whole lotta n**** been waiting. They want some time on it, now I wanna flaunt it. Panty and a bra, we can get involved, boy…”
Her lawyer, Patrick Mincey, said the lawsuit is not about whether officials were entitled to take her crown, but about their alleged actions after that decision. Mincey contended that Boltinhouse was wrongly labeled as a racist, homophobic, and transphobic person, and argued that evidence would show the dethronement was actually due to her support for Donald Trump and Charlie Kirk, as well as her remarks against President Biden's Transgender Day of Visibility.
The same point is made in the lawsuit, which alleges that officials cited her past social media activity to justify concealing the actual motive for removing her. The documents further claim that Boltinhouse's late paternal great-grandfather, Antonio Sosa Figueroa, had identified himself as a Black, Afro-Latino Honduran throughout his life, and a copy of his identification has been submitted as an exhibit.
Boltinhouse was dethroned after posts from 2017 and 2019 resurfaced and reportedly showed her using a racial slur multiple times. A screenshot of the posts in which she used the slur was attached to the filing.
According to the defense outlined in the documents, the posts did not aim to harm anyone, and nothing like that happened. Boltinhouse admits to making the posts but maintains she is not racist, homophobic, or transphobic, and says the backlash that followed harmed her image and led to loss of business and career prospects.
After she was stripped of her title, Brittany Boltinhouse reacted for the first time as she spoke to Carolina Journal on August 5, 2026. She shared that she is not allowed to discuss certain matters, but she believes she was stripped of the title because of her political views and her identity as a conservative Christian woman.
She added that everyone makes mistakes as a teenager, but she does not want to focus on that. She said she wants to talk about who she is today, the hard work she put in as Miss North Carolina USA, and that she had won the title fairly.
Her statement came after Miss USA chairman and CEO Thom Brodeur said that the organization does not accept racism, homophobia, transphobia, or language that takes away a person's dignity. Although he did not share details about her specific actions, he said that he fully stands by it.
